Release of Liability
By accepting this Waiver and Release of Liability (Agreement), you the user (Participant) waive and release the Music Lesson Café its agents, servants, employees, insurers, officers, successors, from any and all claims, demands, causes of action, damages or suits at law and equity of any kind, including but not limited to claims regarding the risk of contracting the COVID-19 virus or other pandemics, epidemics or other medical outbreaks while a person comes into close proximity to another person who is contagious. COVID-19 is known to be highly contagious. Current data suggests that possible methods of transfer include, but may not be limited to, respiratory droplets produced when the infected person breathes, speaks, coughs, or sneezes. Droplets can land in the mouths, noses, or eyes of people who are nearby or possibly be inhaled into the lungs of those within close proximity. Transmission also might occur through physical contact with another contaminated person or contaminated surfaces followed by exposure to the eyes, nose, or mouth. Any exposure to or infection by COVID-19 may result in personal injury, illness, temporary disability, permanent disability, or death. I acknowledge that there is a risk of becoming exposed to or infected by COVID-19 by allowing a teacher to enter the premises of my home. I will not hold the Music Lesson Café liable if I, my child, or the minor in my charge, or other family members or those in close contact with my family members become exposed to or infected by COVID-19. I understand that exposure and/or infection may result from the actions, omissions, or negligence of myself, my child, other family members, any teachers of the Music Lesson Café, and other customers of the Music Lesson Café. I understand that it is possible to obtain the services of the Company via an online video-conferencing platform, and that this platform eliminates any possibility of exposure to COVID-19 while obtaining the services of the Company.
I understand that students and teachers are required to have a temperature taken before in-person lessons begin. A student or teacher with an elevated temperature (100.4 degrees Fahrenheit according the CDC) is asked to organize the lesson online or otherwise cancel the lesson. Students or teachers with an elevated temperature will not conduct in-person lessons.
I understand that the Music Lesson Café has developed and implemented policies based on guidance from the CDC and other state and federal resources to reduce the potential for COVID-19 transmission between its employees and students. I have reviewed and understand, and I agree to abide by, these policies and their requirements. Furthermore, I believe these policies are appropriate, based on current information, to protect all parties involved from the transmission of COVID-19.
Even with the policies and associated preventative measures, I understand that there is an inherent risk of becoming infected with COVID-19 by virtue of accepting lessons on my premises. I understand and accept these risks. I have read the Agreement and understand that by signing the Agreement I have consented to be bound by its terms, including the waiver/release of any legal right I may have to sue the Music Lesson Cafe for any costs they incur because a claim or legal action is brought in violation of this Agreement. I agree any violation of the Agreement and its terms and conditions, as determined by the Music Lesson Café, will void and terminate this Agreement and may result in loss of the ability to continue lessons with the Company.
I am agreeing to this Agreement freely, voluntarily and competently.

How long we retain your data
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
